Umar gave the warning after the prosecution failed for the third time on Wednesday to open its case and call its witness when called upon to do so.
The tribunal chairman, however refused to accede to the request by the defence counsel, Mr. Selekowei Larry (SAN), ruling that the prosecution would be given one more chance to open its case.
He ruled, “Having considered the arguments of parties and in view of the intention of ACJA, which is to fast-track the administration of criminal justice, the prosecution will be given just one opportunity to return and proceed with the case, failing which the tribunal will strike out the case for them to put their house in order.”
